Terms and Conditions

These Terms and Conditions apply to consumer orders placed with EKJ GmbH through canefelis.com.

1. Seller and scope

Your contracting party is EKJ GmbH, Siezenheimer Straße 40, 5020 Salzburg, Austria, FN 646006i, email: info@canefelis.com. Customer terms apply only where we have expressly accepted them.

2. Ordering and formation of the contract

Product displays do not constitute a binding offer. Before submitting an order, customers can review and correct entries, basket contents, delivery details and payment method. By pressing a button that clearly indicates the obligation to pay, the customer submits a binding offer.

The automatic acknowledgement only confirms receipt. A contract is formed when we expressly accept the order, confirm dispatch or finally process the payment. We store the contract text; order details and these Terms are provided by email or through the customer account.

Contracts may be concluded in German, English or Serbian. The language selected during checkout applies.

3. Prices and delivery charges

Consumer prices include applicable VAT. Any delivery charges are shown before the order is submitted. Current details are available under Shipping and Delivery.

4. Payment

Payment methods actually shown at checkout are processed by Stripe and may vary by country, device, currency and eligibility. The conditions described on our Payment Methods page apply. Unless stated otherwise, payment is due when the contract is formed.

5. Delivery

We currently deliver to Austria and Germany. Delivery periods begin when the contract is formed or, for advance payments, when payment is received. We will notify customers promptly of temporary unavailability. Partial deliveries are made only where reasonable and do not result in additional delivery charges.

6. Retention of title

Goods remain our property until paid for in full.

7. Subscriptions

For subscription products, price, delivery interval and billing period are displayed before ordering. The subscription renews automatically for the selected period and the amount due is charged to the saved payment method until cancelled.

Subscriptions may be cancelled at any time through the customer account or by emailing info@canefelis.com. Cancellation takes effect at the end of the current paid billing period. Statutory withdrawal and termination rights remain unaffected. We will give advance notice of price changes; the customer may cancel before they take effect. If a payment fails, we may retry the charge and suspend delivery until payment is received.

8. Coupons, discounts and promotions

Promotion-specific conditions also apply. Unless expressly stated otherwise, only one coupon may be used per order; coupons cannot be combined or redeemed for cash. The maximum discount is €100 per order. Product, customer, minimum order value and expiry restrictions are stated with the relevant offer. We may reject or correct an unjustified discount in cases of misuse, manipulation or technical error.

9. Right of withdrawal

Consumers generally have a statutory 14-day right of withdrawal. Details, exceptions and the model withdrawal form are available under Right of Withdrawal.

10. Statutory warranty

Statutory warranty rights apply. Any product guarantee exists only where expressly stated and does not limit statutory rights.

11. Liability

We are fully liable for intent, gross negligence, personal injury and under mandatory law. For slight negligence, liability is limited to a breach of an essential contractual obligation and to damage that was typically foreseeable. Mandatory consumer rights remain unaffected.

12. Privacy

Details about personal data are provided in our Privacy Policy.

13. Dispute resolution

We are neither obliged nor willing to participate in proceedings before a consumer arbitration body. The former EU ODR platform has been discontinued.

14. Governing law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive them of mandatory protection under the law of their habitual residence. Statutory consumer jurisdictions apply.
